Sean “Diddy” Combs is challenging a court ruling that requires him to pay $100 million to an alleged sexual assault victim.
TSR previously reported that Derrick Lee Cardello-Smith recently gained $100 million after Michigan Judge Anna Anzalone ruled in his favor.
For context, Cardello-Smith filed a civil lawsuit against Combs, recalling a 1997 sexual assault incident.
TMZ reveals that Diddy responded to the claims and lawsuit by filing two emergency motions on Thursday, September 12, to overturn the substantial judgement. The music mogul claims he never received the lawsuit and only discovered it through news coverage.
“Combs, who was never served with this lawsuit, learned about Cardello-Smith and this action for the first time three days ago, when media outlets reported that this court had entered a $100 million default judgment against him,” the motion states.
USA Today notes that Combs’ lawyers are seeking dismissal for improper service and denying any wrongdoing. They argue that the “facially implausible allegations are completely fabricated.”
“This is a frivolous lawsuit against a prominent businessman, based on obvious fabrications, filed by a convicted rapist and serial litigant with an overactive imagination and a thirst for fame,” the motion continues to explain.
TMZ adds that even if the allegations were true — though Diddy’s lawyers argue against them — the statute of limitations expired nearly 17 years ago.
Per TSR, Michigan Judge Anna Marie Anzalone awarded Derrick Lee Cardello-Smith $100 million after Combs reportedly missed the virtual hearing on Monday, (Sept. 9).
Metro Times added that Diddy must reportedly start paying Derrick $10 million per month beginning (Oct. 1).
In his lawsuit, Derrick alleges that Combs drugged and sexually assaulted him following a meeting at a Detroit restaurant. He also asserts that they later attended a party, where they and a group of women undressed.
TMZ notes that while Cardello-Smith was engaging in a sexual act with a woman, he claimed Combs inappropriately touched his left buttock.
Additionally, the now-inmate alleges that Diddy gave him a spiked drink at the time, causing him to pass out.
During an August 7 hearing, Derrick asked for a restraining order and a preliminary injunction to reportedly block Combs from selling property or assets to avoid paying court-ordered judgments.
Derrick represented himself at the hearing, alleging that Diddy and his financial advisor had met with him twice within two weeks, providing visitation records as evidence.
He also revealed that Diddy offered him $2.3 million to withdraw the lawsuit during their first meeting. However, Combs told Derrick he planned to ignore the civil suit and risk the default judgement, per reports.
